RULES AND REGULATIONS "A MUST READ"
BLUE WATER COACH HOMES CONDOMMINIUM
1. These Rules and Regulations shall be cumulative with the covenants, conditions and restrictions set for in the Declaration of Condominium, provided that the provisions of same shall control over these Rules and Regulations in the event of a conflict or doubt as to whether a specific activity is, or is not, permitted.
2. The sidewalks, entrances, passages and like portions of the Common elements shall not be obstructed not used for any purpose other than for ingress and egress to and from the Condominium Property; nor shall any carts, bicycles, carriages, chairs, tables, clothing, shoes or any other objects be stored therein, expect in areas (if any) designated areas determined at the Board of Directors sole discretion.
3. The personal property of Unit Owners and occupants must be stored in their respective Residential Units.
4. No articles other than patio-type furniture shall be placed on the balconies, patios, terraces or lanais or other Common elements or Limited Common of Elements Units. No barbeques are allowed on individual Unit Owners lanais.
5. No Unit Owner or occupant shall permit anything to fall from a window or door of the condominium or Association Property, nor sweep or throw from the condominium or Association Property any dirt or other substance onto any of the balconies, patios, terraces and/or lanais elsewhere in the building or upon the Common Elements. Each Unit Owner shall be responsible for cleaning the Condominium Property, placing all trash and/or garbage in the proper receptacles.
6. No garbage, refuse, trash or rubbish shall be deposited except as permitted by the Association and the refuse service company.
7. No Unit Owner or occupant shall make or permit any disturbing noises by himself or his family, servants, employees, pets, agent’s visitors, or licensees, nor permit any conduct by such persons or pets that will interfere with the rights, comforts, or conveniences of other Unit Owners or occupants. No Unit Owner or occupant shall play or permit to be played any instrument, nor operate a television, radio or sound amplifier in his Unit in such a manner as to disturb or annoy other residents.
8. No repair of vehicles shall be made on the Condominium Property, except for minor repairs permitted by the Association such as jump starts and tire changes. All vehicles must be parked in designated parking spaces. The parking space(s) between buildings are shared space(s) and not to be monopolized. The Parking garage shall not be used for any purpose other parking permitted motor vehicles. (See sec.8.1 Blue Water Coach Homes Declaration of Condominium)
9. No sign, advertisement, notice or other graphics or lettering shall be exhibited, displayed, inscribed, painted or affixed in, or upon any part of the Condominium or the Association property. A
Residential Unit Owner or occupant shall not cause anything to be affixed or attached to, hung, displayed or placed on the exterior walls, doors railings or windows of the Building. Additionally, no awing, canopy, shutter or other projection shall be attached or placed upon the outside walls or roof of the Building or on the Common Elements, without the prior written consent of the Board of Directors of the Association. No window air-conditioning units may be installed by Unit Owners or occupants.
10. No flammable, combustible or explosive fluids, chemicals or substances shall be kept in any Residential Unit or the Common Elements, other than as is reasonable and customary in vehicles and/or in cleaning supplies.
11. Any Unit Owner or occupant who plans to be away for an extended period must make arrangements to secure the unit in the event of storm or other emergency. The secretary of the Board of Directors must be notified of the name and contact number of the person(s) designated to secure the unit. The Board of Directors reserves the right to approve the designated person. Unit Owners and occupants who plan to leave their units for an extended period of time are asked to shut off water supply to the unit. This shut-off is found in the courtyard of each building. HURRICANE SHUTTER SPECIFICATIONS: All window openings shall have original galvanized manually installed shutter panels, or an outside mount white roll down or accordion type. The lanai openings may be either tan or white in color to include the above types or hurricane approved fabric type. The side lights by the front door and laundry/utility window upstairs may be covered by accordion, roll down or Lexan. All shutters installations shall be approved by the Board of Directors and forms are available on the website for this purpose.
12. Key/Access. The Association and Board of Directors requires every owner to deliver two keys to the management company for retaining in a safe and locked up area access in the event of an emergency, fire sprinkler access for use of the Association pursuant to its rights of access to the premises.
13. Children will be the direct responsibility of their parents or legal guardians, including full supervision of them while within the Condominium Property and including full compliance by them with these Rules and Regulations and all other rules and regulations of the Association. Loud noises by children will not be tolerated. All children under twelve (12) years of age must be accompanied by a responsible adult when entering and/or using the recreational facilities.
14. Each Unit shall contain no more than one (1) household pet not to exceed eighty (80 lbs.) in the unit, subject to the terms and restrictions of Sec.12.6 of Blue Water Coach Homes Declaration of Condominium. Household pet shall mean dogs, cats and any other animals expressly permitted by the Association, if any. The following breeds of dogs have been determined to be dangerous and are not permitted: Pit bulls, Rottweilers, Chow Chows, Doberman Pinchers, German Shepherds, Siberian Huskies, Perro de Presa Canarios, Alaskan Malamutes, Akitas, American Stafford Terries, Boxers, Great Danes, Wolf Hybrids, Bull Mastiffs, and any dog that has any of the herein named breeds in their lineage. All pets shall be kept on a leash no greater than eight feet (8’) in length or carried by a responsible person when outside in Common Elements. Unit Owners or occupants shall be responsible for cleaning up pet’s excrements. Bags for this pick-up are available at three locations in the community for your convenience. Pets are not permitted in the fenced-in pool area or the Club House.
15. Every applicable Owner and occupants shall comply with these Rules and Regulations as set forth herein, any and all rules and regulations which from time to time may be adopted, and the
provisions of the Declaration, By-Laws and Articles of Incorporations of the associations, as amended from time to time. Failure of an Owner or occupant to so comply shall be grounds for action which may include, without limitation, an action to recover sums due for damages, injunctive relief, or any combination thereof. In addition to all other remedies, in the sole discretion of the Board of Directors of the Association, a fine or fines may be imposed upon an Owner for failure of an Owner, his family, guests, lessees, or employees, to comply with any covenant, restriction, rule or regulation herein or in the Declaration, Articles of Incorporation or By-Laws, provided the following procedures are adhered to: (a) Notice: The party against whom the fine is sought to be levied shall be afforded an opportunity for hearing after reasonable notice of not less than fourteen (14) days and said notice shall include:(i) a stamen of the date, time and place of the hearing; (ii) a statement of the provisions of the Declaration, Association By-Laws or Association rules which have allegedly been violated;(iii) a short and plain stamen of the maters asserted by the Association.
(b) Fines: The Board of Directors may impose fines against applicable Unit up to maximum amount permitted by the law.
(c) Hearing: The non-compliance shall be presented to a committee of other Unit Owners, who shall hear reasons why penalties should be imposed. The party against whom the fine may be levied shall have an opportunity to respond, present evidence, and to provide written and oral argument on all issues to any material considered by the committee.
(d) Violations: Each separate incident which is grounds for a fine shall be the basis of one separate fine. In case of continuing violations, each continuation of the same after a notice thereof is given shall be deemed a separate incident.
(e) Payment of Fines: All monies received from fines shall be allocated as directed by the Board of Directors.
(f) Applications of Fines: All monies received from fines shall be allocated as directed by the Board of Directors.
(g) Non-Exclusive Remedy: The fines shall not be constructed to be exclusive and shall exit in addition to all other rights and remedies to which the Association may be otherwise legally entitled; however, any penalty paid by the offending Owner or occupant shall be deducted from the offset Against any damages which the Association may otherwise be entitled to recover by law from such owner or occupant.
16. A Unit Owner intending to lease their unit on annual or seasonal basis shall give the Management Company and Association written notice of such intention and follow all requirement and procedures per Parg.13 of the Declarations. A full background check, lease and all required paperwork shall be furnished for approval to Management and Association and pay all required fees prior to any tenant taking occupancy. The Management and Association shall not require full background check on any annual lease renewal by the current tenant, or a seasonal lease renewal from the same returning tenants that occupied the same premises from the same landlord in the past three (3) years. In the event Landlord and Tenant renew any lease after a 3-year history, then the Management and Association shall require a minimum criminal background check. No unit shall be leased for less than 30 days, no more than four (4) times per year.
17. These rules and regulations shall be cumulative with the covenants, conditions and restrictions set for in the Declaration of Condominium, provide that the provisions of same shall control over these rules and regulations in the event of a conflict or doubt as to whether a specific practice or activity is or is not permitted.
18. Appropriate clothing cover-up must be worn in common areas wen going to and from pol, fitness room, and the like.
19. Clubhouse Pool Rules: (a) Clubhouse may be reserved by listing the event on the sign-up sheet on the bulletin board in the clubhouse.
(b) Reservation notice must be posted and include, Owner or renters name, date and hours of use.
(c) Reservations will only include the clubhouse, not exclusive use of the pool or grill areas.
(d) No smoking, drug use or excessive noise permitted in the Clubhouse or pool area.
(e) Clubhouse must be cleaned and left in the same condition as arrival, immediately after use.
(f) Pool hours are Dawn to 10:00pm
(g) Absolutely no glass or pets in the pool are. (STATE LAW)
(h) Visitors must be accompanied by a resident of Blue Water at all times.
These Rules and Regulations shall apply to all owners and occupants even if not specifically so stated in portions hereof. The Board of Directors shall be permitted (but not required) to grant relief to one or more-unit owners from specific rules and regulations upon written request thereof and good cause shown in the sole opinion of the board. The Board of Directors, at sole discretion, may modify the above-refenced Rules and Regulations as needed.
